Booking terms
Draft for review. These terms must be checked by someone who knows Philippine consumer law (including the Consumer Act, RA 7394) before launch. Items marked [TBD] depend on business decisions not yet made.
Last updated: [TBD]
1. Who we are and what we do
pinoysolar.com ("we", "us") is a booking agent. We connect customers in Cebu with independent solar installation teams ("the installer"), arrange the booking, collect and hold the deposit, and coordinate the schedule. We do not manufacture, sell or install solar equipment, and we are not the installer's employer.
2. Requests and quotes
Sending a request through our website does not create a booking or any obligation to pay. After you send a request, a booker contacts you to discuss the job. Any price we give before a site check is an estimate and may change once the installer has seen the site.
3. Booking and deposit
- A booking is confirmed only when you have agreed the job and the deposit with us and we have received the deposit.
- The deposit amount is [TBD: fixed amount or percentage of the job price] and is confirmed to you in writing before payment.
- We accept deposits by GCash or bank transfer to the accounts we give you in writing. We will never ask you to pay to a personal account that has not been confirmed in writing by us.
- We hold the deposit until [TBD: e.g. the installation start date / completion], then apply it to the job as set out in your written confirmation.
- The balance of the job price is paid as agreed in your written confirmation. [TBD: whether the balance is paid to us or to the installer.]
4. Cancellations and refunds
- If we cannot book a suitable installer for your job, we refund the deposit in full.
- If the installer finds at the site check that the job cannot be done as agreed and you do not accept a revised plan, [TBD: full or partial refund].
- If you cancel after the booking is confirmed: [TBD: refund rules by notice period].
- Refunds are paid to the account the deposit came from, within [TBD] business days.
5. Who is responsible for what
Three parties are involved in your installation, each responsible for a different part:
- The installer is responsible for the quality of the installation (workmanship): mounting, wiring, waterproofing, compliance with applicable electrical codes, and the system working as installed. Workmanship warranty is given by the installer, on the terms the installer provides to you in writing.
- The hardware vendor or manufacturer is responsible for the equipment (panels, inverter, battery and other components). Equipment warranty is given by the vendor or manufacturer, on their terms.
- We are responsible for arranging the booking, handling your deposit as described in these terms, and coordinating the schedule. We do not give a workmanship or equipment warranty. If there is a problem, we will help you reach the right party and follow up on your behalf.
Nothing in these terms limits any rights you have under Philippine law that cannot be limited by agreement, including your rights under the Consumer Act of the Philippines.
6. Our responsibility
We take reasonable care in choosing the installers we work with. We are responsible to you for handling your deposit as set out above and for the accuracy of what we tell you about your booking. [TBD: liability cap and exclusions, to be drafted with counsel.]
7. Your responsibilities
- Give us accurate information about your site, your electricity use and your contact details.
- Make sure the installer can safely access the site on the agreed dates.
- Obtain any permission needed from the property owner, condominium or homeowners' association.
8. Personal information
We handle your information as described in our privacy notice.
9. Changes to these terms
We may update these terms. The version that applies to your booking is the one in force when your booking was confirmed.
